1. terms and conditions of sale

The Seller sells pet food and pet supplies, selling directly to the end consumer through the website http://www.petness.pt.
A list and description of the products offered by the Company can be found on the above website. These terms are a contract between the Company and the person making the purchase of products from the Company, hereinafter referred to as the "Buyer" or "Customer"
Article 1: Subject matter
These Terms and Conditions determine the rights and obligations of the parties involved in connection with the online sale of products offered by the seller.
Article 2: General Provisions
These General Terms and Conditions apply to all sales of products, made through the company's website which form part of the contract between the buyer and the seller. The Seller reserves the right to modify these terms at any time by posting a new version on its website. The applicable Terms are those below, and are in force on the date of payment (or of the first payment in the case of several payments) of the order. These Terms are available on the Company's website at the following address: http://www.petness.pt. The company also ensures that your acceptance is clear and unconditional by creating a check box and clicking validation. The Client declares to be aware of all these Terms and Conditions. The Customer acknowledges that he has received the necessary information and advice to ensure the suitability of the offer to his needs.
Article 3: Price
The prices of products sold through websites are in euros, inclusive of taxes and explicit on the product pages. All taxes included (VAT + other taxes) are also indicated in euros on the product order page. The Company reserves the right to change prices at any time in the future.
Article 4: Conclusion of the online contract
The Customer must follow a series of steps to place an order:
• Access to information about the essential characteristics of the product;
• Selection of the product, of any options and indication of the customer's essential data (identification, address ...);
• Acceptance of these Terms and Conditions;
• Verification of the order details and, where appropriate, correction of errors.
• Follow the instructions for payment and shipping options;
• Delivery of the items. The customer will receive an e-mail confirmation of the payment of the purchase, as well as confirmation of receipt of the order. Delivery will be made to the address specified by the Customer. For the proper execution of the order, the Customer undertakes to provide his true identification data.
The Seller reserves the right to refuse the order in case of any abnormal request, made in bad faith or for any other legitimate reason.
Article 5: Products and Services
The essential characteristics of the goods, services and their respective prices are made available to the buyer on the company's website. The customer confirms having received a detailed delivery cost and the terms of payment, delivery and performance of the contract. The seller undertakes to fulfil the customer's order within the limits of available stocks. In the event of unavailability of stock, the seller must inform the customer. This contractual information is presented in detail and in Portuguese. The parties agree that illustrations or photographs of the products offered for sale are not contractual. Except in special circumstances, the rights granted herein are only for the person who finalised the order (registered e-mail address holder) .In accordance with legal requirements, the seller will refund or exchange products that are defective or do not correspond to what was ordered. The refund can be requested as follows: paypal, bank transfer or in credit to the customer's account in the form of Pointness. The exchange of items will be made free of charge if the error was the responsibility of the company. If the customer has made a mistake and wants to exchange items, he will be responsible for the shipping costs.
Discount coupons are applied to the value of the products excluding VAT and are never applied to transport costs or other extra charges.
Article 6: Reservation of title
Products remain the property of the company until paid in full.
Article 7: Availability and presentation
Orders will be processed within the limits of available stocks and subject to supplier availability. In case of unavailability of an item for a period longer than 2 days, the Customer will be immediately notified of foreseeable delivery times and the order for this item may be cancelled upon request. The Customer may then request a credit for the value of the item or a refund.

Article 10: Return

The customer benefits from a period of fifteen days from the date of receipt of the articles to return the order without any grounds or penalty, except , when applicable, the cost of transport involved. The period referred to in the previous paragraph shall run from the receipt of the goods or the acceptance of the offer of services. The right of return may be exercised by contacting the company by e-mail at [email protected].
In case the right of return is exercised, only the value of the items shall be returned and not any shipping costs previously incurred by the Customer.
Product returns can only be made if they are in their original condition and complete (packaging, accessories, manuals ...) so that they can be resold as new; they must, if possible, be accompanied by a copy of the sales receipt.
Article 11: Guarantees
In accordance with the law, the Seller assumes two guarantees: the conformity and completeness of the items. The Seller will reimburse the buyer or exchange products that are defective or do not correspond to what was ordered.

Article 12: Complaints
If necessary, the buyer can make any complaints by contacting the company by e-mail at [email protected].
Article 13: Intellectual Property Rights
Trademarks, domain names, products, software, images, videos, texts or generally any object of information intellectual property rights are and remain the exclusive property of the seller. No assignment of intellectual property rights is undertaken through these Terms. Total or partial reproduction, modification or use of such property for any reason is strictly prohibited.
Article 14: Force majeure
The implementation of the seller's obligations for the duration of this contract shall be suspended upon the occurrence of an unforeseeable event or force majeure which prevents its execution. The vendor shall inform the customer of the occurrence of such an event as soon as possible.
Article 15: Nullity and amendment of the contract
If any provision of this contract is cancelled, this shall not result in the nullity of the other provisions which remain in force between the parties. Any contractual modification is only valid after a written contract between the parties.
Article 16: Applicable law
All clauses of these general conditions of sale, and all purchases and sales contemplated therein, shall be subject to Portuguese law.

Article 17: Tranquility Guarantee
17.1- When you place an order, you have the option of adding the Tranquillity Guarantee to your purchase. With this service you will benefit from the following advantages:
- 30 days to return: The period for the customer to return the order is extended to 30 days instead of the usual 15 days. In the case of a return for a reason other than error/damage on the part of the shop or carrier, the customer must bear the shipping costs.
- Delivery insurance: With this service your order is insured. If your order arrives in bad condition, we will immediately send a new one (subject to stock availability) at no cost or we will refund the amount you paid the same day.
The client must send us photos of the products, proving the state in which they arrived at their destination.
- Priority customer support: Your messages will be the first to be answered, we guarantee you a response in less than 2 hours (during office hours: working days 9h-13h and 14h-18h)
- Order tracking: You will know where your order is at all times, you will receive an email notification when it leaves the warehouse and with information on the delivery process.
17.2- Right to cancel the Tranquility Guarantee: the customer has the right to cancel the Tranquility Guarantee service at any time, as long as the order has not yet left our warehouse or has not benefited from any of the advantages mentioned above.
